Paths Selected Via Objects Menu Dont Respond After Replacing

When a path or area is created, then the stamp is selected via the object menu I cannot adjust the layer with ctrl+up arrow. I have to hit v or open the selection tool first.

Example with PT.

1) place a new path

2) select a group, object, or path in object menu

3) hit ctrl+up arrow

4) layer decrements in the left hand path menu but not in the right hand object menu

5) actual object reflects the layer in the object menu

6) switching to the selection tool returns functionality

Seems strange that you can select an object with the path tool open but the settings are not being applied to the selected object.
